TERMS OF USE: PUREMATCH (PTY) LTD

1. DEFINITIONS

1.1. “Company” refers to PureMatch (PTY) LTD, a private company registered in the Republic of South Africa, and the exclusive owner and operator of www.purematch.co.za (the “Website”). 1.2. “Service(s)” refers to your use of the Website for any purpose, including but not limited to: creating a profile, browsing profiles, and communicating with other users. 1.3. “You” refers to the user of the Website and its related services. 1.4. “User Content” refers to the material you publish on the Site or send to other members, excluding personal contact information (telephone number, email address, password). 1.5. “Dating Pro Network” refers to the centralized database and message exchange system utilized by the Company to facilitate matches.

2. ACCEPTANCE OF TERMS

2.1. This Agreement was last updated on January 19, 2026. 2.2. By using our Site, you agree to be bound by these Terms of Use. If you do not agree, please cease use of the Site immediately. 2.3. Modifications: We reserve the right to modify this Agreement. Changes will be posted on the Website and become effective immediately. Continued use constitutes acceptance.

3. RIGHTS AND OBLIGATIONS OF THE COMPANY

3.1. Monitoring: We reserve the right, but have no obligation, to monitor advertisements, public postings, and messages to ensure they conform to our content guidelines and South African law (including the Cybercrimes Act). 3.2. No Responsibility: The Company is not responsible for any interruption or suspension of Service, regardless of cause.

4. PRIVACY AND DATA PROTECTION (POPIA)

4.1. Compliance: The Company processes all personal information in accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA). 4.2. Consent: By using the Service, you provide express consent for the collection, processing, and storage of your personal data for matchmaking purposes. 4.3. Special Personal Information: You acknowledge that by providing information regarding your race, religion, or sexual orientation, you are consenting to the processing of "Special Personal Information" as defined under POPIA.

5. RIGHTS AND OBLIGATIONS OF USERS

5.1. Eligibility: You must be 18 years of age or older. By using this Site, you warrant that you have the legal capacity to enter into a binding contract in South Africa and have not been convicted of a felony or sexual offense. 5.2. Code of Conduct: You shall not:

  • Use the Service for any unlawful purpose.

  • Post defamatory, racist, sexist, or offensive material.

  • Engage in "catfishing" or identity misrepresentation.

  • Distribute "revenge porn" or non-consensual intimate images, which is a criminal offense under the Cybercrimes Act. 5.3. User Safety: YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS. The Company does not conduct criminal background checks. We urge you to follow safety protocols.

6. PAID MEMBERSHIPS AND PAYMENTS (ECTA & CPA)

6.1. Fees: You shall pay an admission fee of R [Insert Amount] and a monthly subscription fee of R [Insert Amount]. All prices are in South African Rand (ZAR) and inclusive of VAT. 6.2. Cooling-Off Period: In terms of Section 44 of the Electronic Communications and Transactions Act (ECTA), you may be entitled to a 7-day cooling-off period, provided the services have not commenced with your consent. 6.3. Cancellations: You may cancel at any time via account settings. Refunds are handled in accordance with the Consumer Protection Act (CPA).

7. LIMITATION OF LIABILITY

7.1. To the extent permitted by South African law, PureMatch (PTY) LTD shall not be liable for any direct, indirect, or consequential damages arising from meeting other users or the use of the Service. This includes, but is not limited to, emotional distress or bodily injury.

8. DISCLOSURE BY LAW

8.1. We may disclose your information if required by a court order, a subpoena, or the Regulation of Interception of Communications and Provision of Communication-related Information Act (RICA).

9. TERMINATION

9.1. Either party may terminate this agreement at any time. To delete your profile permanently, go to "Settings" > "Delete Profile." Upon deletion, your data will be scrubbed from our active database, subject to our statutory data retention obligations under South African law.

10. GOVERNING LAW

10.1. This Agreement is governed by the laws of the Republic of South Africa. Any disputes shall be settled in the Magistrate’s Court or High Court of South Africa having jurisdiction.
